1. Data We Collect

ActCheck is designed to minimize data collection. When you use the Service, we may collect:

• Session Data: Your questionnaire answers are stored temporarily in anonymous sessions (/tmp/actcheck_sessions/), automatically deleted after 90 days. We do not associate your answers with your personal identity.
• Email Address (if provided): If you choose to email yourself a report link as backup, we temporarily process your email address. Emails are not permanently stored, not used for marketing, and not shared with third parties.
• Contact Form Data: Name, email, and message submitted via the Contact Us form. Used to respond to your inquiry, deleted within 90 days of resolution.
• Payment Information: Payments are processed by Lemon Squeezy. We do not receive, store, or access your credit card numbers or full billing details. We receive an order ID and product type purchased from Lemon Squeezy.

We do not use tracking cookies, serve advertisements, perform fingerprinting, or conduct cross-site tracking.

2. Why We Collect Data

• Service Delivery: Your questionnaire answers generate your self-assessment report — the core function of the Service.
• Customer Support: If you contact us, we use your information to respond.
• Legal Obligations: We may disclose limited data if required by law (e.g., valid court order).

3. Legal Basis (GDPR)

For EEA/UK users, we process personal data on the following legal bases:

• Contractual Necessity: Processing questionnaire answers to generate the report you requested.
• Consent: When you choose to provide your email address for backup purposes.
• Legitimate Interest: Responding to customer support inquiries.

4. Data Retention

• Anonymous sessions (questionnaire answers + generated reports): 90 days then auto-deleted.
• Contact form submissions: 90 days after resolution.
• Email backup records: Deleted within 30 days of sending.

5. Data Storage

All data is stored on our server in Hong Kong (Tencent Cloud). Data processing occurs on this server. No data is transferred outside the server environment except as described in Section 6.

6. Third-Party Services

We use the following third-party services which may receive limited data:

• Lemon Squeezy: Processes payments. Receives order details and email address (if provided). See their Privacy Policy.
• ImprovMX: Handles email forwarding for @actcheck.co addresses (e.g. support@actcheck.co). Receives sender and recipient addresses. See their Privacy Policy.
• Resend: Sends contact form notification emails and (future) post-purchase report emails. Receives sender and recipient email addresses and message content. See their Privacy Policy.

7. Your Rights

Depending on your jurisdiction, you may have the right to:

• Access the personal data we hold about you.
• Request correction or deletion of your data.
• Withdraw consent (where processing is based on consent).
• Lodge a complaint with your local data protection authority.

To exercise these rights, email support@actcheck.co. We respond within 30 days. Note: since we store minimal data in anonymous sessions, we may not be able to identify your specific data without a session ID.

8. Data Security

We implement appropriate technical measures: TLS 1.2+ encryption for all data in transit, server-side access controls, and regular security updates. Assessment data is stored on our server in Hong Kong. No data is transferred outside the server environment except as described in Section 6.
