1. Nature of Service

ActCheck ("the Service") provides informational self-assessment and evidence-readiness reports based on your answers to questionnaires about GDPR/ePrivacy, EU AI Act, and EU consumer/digital fairness readiness topics. The Service:

• Is a self-assessment tool, not a law firm or legal service provider.
• Does not establish an attorney-client relationship.
• Does not provide legal advice, legal strategy, defense arguments, or litigation guidance.
• Outputs are limited to: compliance material checklists, internal process suggestions, and evidence preparation templates.
• When a report recommends "professional review," this means exactly that — consult a qualified lawyer. The recommendation is triggered by specific gaps in your self-reported answers.

2. No Legal Advice

All content provided through the Service — including questionnaires, gap analyses, action steps, enforcement case references, and PDF reports — is for informational purposes only. It does not constitute legal advice. Regulations change, enforcement practices vary by jurisdiction, and every situation is unique. You should not act or refrain from acting based on any information from this Service without first consulting a qualified legal professional in your jurisdiction.

3. Jurisdiction & Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection, digital content, data protection, or other mandatory laws. If mandatory local law gives you rights that cannot be waived by contract, those rights continue to apply.

4. Pricing, Taxes & Payment

The current public launch price is displayed at checkout and on the ActCheck website. Unless a prior price is supported by real public price history, ActCheck should not be read as offering a strikethrough or "was" price discount. Taxes/VAT, if applicable, are shown at checkout by Lemon Squeezy.

5. Limitation of Liability

To the fullest extent permitted by applicable law:

• Liability Cap: Our total liability for any claim arising from your use of the Service is limited to the amount you paid us for the specific report giving rise to the claim. If you used the free service, our liability is limited to zero.
• No Indirect Damages: We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: regulatory fines, penalties, legal fees, lost profits, business interruption, or reputational harm — even if we were advised of the possibility.
• No Compliance Guarantee: We make no warranty that using the Service will result in regulatory compliance, avoid fines or penalties, or satisfy any third party's requirements.

6. Report Accuracy & Updates

Reports are generated from a knowledge base with a specific version date (printed on each report). Regulations and their interpretations evolve. We update our knowledge base periodically but make no commitment to update it for every regulatory change. A report reflects the knowledge base version at the time of generation. Purchases are for the report as-is at that time and do not include future updates.

7. Refund Policy

You may submit a refund request within 7 days of verified payment or first report delivery, whichever comes first. This is ActCheck's additional operational review window and does not limit any non-waivable consumer, digital content, payment, or data protection rights you may have under applicable law. Refunds are not automatic and require ActCheck review and approval. Refunds are generally limited to duplicate purchase, failed delivery, or a material report error, but statutory rights may provide additional remedies. To request review, use our refund request page or email support@actcheck.co. Approved refunds void the related report — the report ID is deactivated and online report links are disabled. If you retain a downloaded copy after refund approval, it is no longer valid for any purpose and continued use may constitute a breach of these Terms.

8. Error Correction & Feedback

If you believe a report contains a factual error (e.g., incorrect article reference, outdated fine amount, missing exemption), please email support@actcheck.co with the specific claim, the report's session ID, and your suggested correction with a source reference. We review all correction requests and update our knowledge base where appropriate.

9. Intellectual Property

The Service, including its questionnaires, knowledge base, gap analysis methodology, report templates, and branding, is owned by ActCheck. You receive a non-exclusive, non-transferable right to view and download your generated reports for your internal business purposes. You may not resell, redistribute, or white-label the reports.

ActCheck is operated by an individual based in Beijing, China. For questions about these Terms, legal notices, or support, contact support@actcheck.co. Support is provided by email only. ActCheck does not currently publish a phone support channel, trade register number, VAT registration number, or regulated professional status.
